Property Registry & Title Checks in Georgia

A scoped legal review of an identified property's registry records, rights and restrictions before a purchase, payment or other decision.

Confidential assessmentConsultation language agreed in advanceScope, language and timing confirmed before engagement

Advokato can help a buyer, owner or investor understand what available Georgian property records establish and what remains unresolved. The agreed work can identify the exact land or unit, compare dated extracts and relevant documents, assess registered rights and restrictions, and flag authority or record discrepancies. You receive findings tied to named sources and dates, with limitations and conditional next steps. This is a property-record review; broader transaction due diligence, surveys, drafting, registration and disputes require separate agreed scope.

The right route starts by assessing current law, facts, documents and deadlines together. This page provides a practical framework; an individual strategy is formed only after a confidential case assessment.

Read the source with its date, legal effect and limits. A record review supports a decision; it is not an unconditional title guarantee.

  1. Public Registry Law, Articles 5–6: registered data have a statutory presumption of accuracy. Public access has legal exceptions and procedural conditions; obtaining originals is not the same as inspecting public information.
  2. Article 10: the property extract reflects registered data valid when prepared, including the relevant rights, restrictions, tax security and Debtors Registry sources. It is not a prediction of later changes.
  3. Civil Code, Articles 183, 185 and 312: acquisition by agreement requires writing and registration. Registry reliance has exceptions involving knowledge and challenges; the recorded constitutional qualification must be considered in the case.
  4. Personal Data Protection Law, Articles 4–5: identify an applicable lawful basis and limit collection to the purpose. Public availability does not remove duties of necessity, accuracy, retention and security.

Procedure

How the matter is managed

  1. 01

Describe the property type, your role, the intended decision and any signing or payment deadline. Identify whether a deposit or agreement already exists.

  2. 02

Confirm the exact objects, lawful purpose, sources, access permissions, report format, language and professional and third-party costs before work starts.

  3. 03

Obtain or check dated extracts and relevant cadastral or registration material where lawfully available. Record missing documents and requests awaiting a response.

  4. 04

Compare the object, registered owner, rights, restrictions and relevant authority documents. Separate sourced findings from client statements and unresolved inconsistencies.

  5. 05

Deliver the agreed findings and follow-up list. Identify conditions to resolve before the decision and whether a fresh registry check is needed nearer signing or payment.

Documents

Initial checklist

  • Initially: property type and stage, a neutral label such as Apartment A, whether a deposit exists, your questions, deadline and preferred contact. Do not attach identity scans or bank records.
  • Through an agreed channel: cadastral identifier, current extract and relevant plan; retain the date, source and complete pages of each record.
  • Available title or registration decisions, proposed agreement and relevant authority or consent documents, limited to the agreed questions.
  • Records explaining a known mortgage, restriction or discrepancy, with authority or another applicable basis to share non-public information. Keep originals; a copy alone does not prove authenticity.

Risks

Common mistakes

  • An old extract may concern another unit or miss a later entry. Check the cadastral identifier and record date, not only the address.
  • No entry found in the checked sources does not mean no unregistered right, dispute or other risk exists.
  • A cadastral plan is not an engineering inspection, valuation or independent physical boundary survey. Permits and developer checks need explicit additional scope.
  • A seller's promise to release a mortgage is not its removal from the registry. A consultation does not extend contractual payment or objection deadlines.

Typical scenario

From facts to an action plan

Hypothetical example: an unnamed buyer has an older extract for Apartment A and a draft promising mortgage release before payment. The review checks the exact unit and dated registered entry, asks for the release basis and a fresh record, and lists unresolved payment conditions. It does not certify the seller as safe or promise that the mortgage will be removed.

FAQ

Direct answers to practical questions

Answers are general and do not replace individual legal advice.

01What does the report contain?+

Agree a dated source list, identified property and records, findings, discrepancies, missing evidence and conditional next steps. Copies or extracts are included where lawfully available and agreed. The report distinguishes verified entries, statements and open questions; it does not issue an official certificate or a universal risk score.

02How are professional fees calculated?+

The quote depends on the number of properties and units, record history, access, document volume, discrepancies, languages and urgency with confirmed availability. Official records, translation and other third-party costs are identified separately. Broader diligence, negotiations, drafting, registration or a dispute are included only if expressly agreed.

03How long does the check take?+

Confirm the preparation and report timetable after reviewing scope and record availability. Agency service periods are different from the lawyer's analysis time. Missing identifiers, archived records, replies and discrepancies may extend the work. Agree whether to refresh the records before signing or payment; no instant completion is promised.

04Is this a full purchase investigation?+

No. This service focuses on specified registry and title-record questions. A broader property due diligence engagement may also cover transaction structure, construction or municipal records and developer documents. Contract review assesses the agreement text; drafting creates terms. Technical inspection and valuation require the appropriate separate specialists.

05Can you investigate the owner's private background?+

This service does not offer unrestricted personal investigations, criminal files, private bank records or covert information. Any necessary personal data requires an applicable legal basis, a defined purpose and proportionate handling. Restricted or sensitive material needs its own access and legal assessment; a name match is not identity confirmation.

06Which official record charges are currently listed?+

NAPR's tariff checked on 27 October 2026 lists an extract at 20 GEL in one working day or 75 GEL on the filing day; online requests are 13 or 52 GEL respectively. An English extract adds 26 GEL. A cadastral plan is 7 GEL in one working day or 26 GEL on the filing day. These are agency charges for the selected product and channel, not Advokato fees or a promise of a completed legal report. Recheck the tariff when ordering.
