Title Registration

Register ownership of Georgian immovable property with a clear filing checklist, representation arrangements and follow-up on the registry's decision.

Confidential assessmentConsultation language agreed in advanceScope, fees and preparation time agreed after assessment

Advokato can help buyers, recipients, heirs and other applicants identify the legal basis for registration and prepare the appropriate application, subject to an agreed scope, conflicts and availability. The work may include a document-gap list, filing package, authorised submission, responses to registry notices and a handover of the decision and extract. A sale agreement or payment alone does not complete acquisition of ownership by agreement: Article 183 of the Civil Code also requires registration. Contested title, first land registration and cadastral corrections may need additional procedures.

The right route starts by assessing current law, facts, documents and deadlines together. This page provides a practical framework; an individual strategy is formed only after a confidential case assessment.

The Civil Code and the Law on Public Registry distinguish the underlying right, the application and the registration decision. The right filing route depends on the existing records and the document establishing the applicant's entitlement.

  1. Written transaction and registration: Civil Code Article 183 requires both for acquisition by agreement. Other bases, such as inheritance or a court act, require their own supporting documents.
  2. Application and evidence: Article 8 of the Public Registry law requires the prescribed registration documents and information. Check identities, representation and the specific property or share being requested.
  3. Suspension: Article 21 covers missing documents, form or identification problems and certain cadastral defects. Its general 30-calendar-day suspension period has exceptions; check the ground and the period applicable to the actual notice.
  4. Outcome of defects: failure to remedy a suspension ground within the applicable period can terminate the proceedings under Article 22. Article 23 separately addresses refusal, including incompatible registered rights or a document issued by an unauthorised person.
  5. Scope limits: an extract records registered information; it does not replace a wider property investigation. Contract drafting, review, diligence, disputed title, surveying and appeals should have their own agreed tasks and fees.

Procedure

How the matter is managed

  1. 01

Describe the property, how ownership arose or will arise, the current registry position and any application or notice already received. Agree the scope, language, fees and preparation timetable.

  2. 02

Match the legal basis, applicant, property identifier and share being registered. Identify missing authority, consents, signatures, cadastral information or foreign-document formalities.

  3. 03

Assemble the application package and settle the signing and filing method. Confirm the applicable registry service and charge; a faster processing option does not cure incomplete documents.

  4. 04

Under the agreed authority, submit and retain the application reference and payment evidence. Monitor the decision and prepare any included response to a suspension or document request within the applicable period.

  5. 05

Check the decision and resulting extract against the requested owner, property and share. Hand over the filed documents, evidence and outstanding actions; agree separately on a challenge or further correction if needed.

Documents

Initial checklist

  • For the first enquiry: property type and location, cadastral code if known, intended registration, transaction or inheritance stage, relevant dates and any registry-notice deadline. Avoid passport scans or personal numbers in the public form.
  • Through an agreed channel: applicant identification and, for a representative or company, the power of attorney, corporate records and signing authority appropriate to the application.
  • The document supporting registration, such as an executed transaction, inheritance certificate, effective court decision or relevant administrative act. Its suitability and formal requirements depend on the route.
  • Available registry extract and cadastral plan, the exact property or share, and any survey or supporting technical documents required for that particular filing. A private sketch is not automatically an acceptable cadastral document.
  • Required consents, signature certification, translations and applicable apostille/legalisation or exemption; previous applications, decisions, notices and fee receipts. Confirm the actual list before signing abroad or ordering documents.

Risks

Common mistakes

  • Treating payment, possession or a signed agreement as a substitute for registration of ownership acquired by agreement.
  • Filing with inconsistent names, property identifiers, shares or authority, or leaving a relevant restriction unresolved.
  • Missing the period for responding to a suspension notice, which can lead to termination of the application.
  • Assuming an ordinary transfer fee covers initial land registration, a boundary dispute or recognition of ownership.

Typical scenario

From facts to an action plan

Hypothetical example: a buyer has a signed contract for an already registered apartment, but the purchaser's name and the ownership share do not match across the documents. The lawyer identifies the discrepancies, establishes how they should be corrected and prepares the supported filing. Paying for faster registry processing does not remove those defects. This is an illustration, not a client result or a promise of registration.

FAQ

Direct answers to practical questions

Answers are general and do not replace individual legal advice.

01What will I receive from the lawyer?+

Agree a document-gap checklist, application package, representation and filing evidence, included responses to registry notices, and a handover of the decision and extract. Record which corrections, repeat applications or appeals are included. Drafting the underlying contract and investigating the property are separate services unless expressly added.

02What are the official and professional fees?+

NAPR's schedule for registration of the origin, change or termination of an immovable-property right lists GEL 150 for four working days, GEL 270 for one working day, or GEL 350 on the filing day. These are agency charges, not Advokato's fees or a total budget. Other registration routes have different charges. Legal fees depend on the documents, parties, property units, authority, languages, defects and agreed follow-up. Surveying, notarial work, translation, legalisation and additional extracts may cost extra. Obtain a written scope and quote.

03How long does registration take?+

The four-working-day, one-working-day or filing-day options concern the ordinary registry service after filing. Preparation, signatures, foreign documents, suspensions and corrections can extend the overall timeline. Initial land registration and cadastral procedures may follow different periods. Confirm the applicable route and current conditions before choosing a service; no approval or completion date is guaranteed.

04Can I apply through a representative from abroad?+

Representation may be possible with suitable authority and compliant documents. Confirm the exact signing act, powers, document origin, translation and any certification, apostille/legalisation or exemption before execution. Property type and applicant status may affect the legal assessment; foreign nationality is not a universal entitlement to every land category.

05What if the registry suspends or refuses the application?+

Send the decision, application reference, supporting documents and notification date promptly through the agreed channel. A suspension, termination and refusal have different consequences. The lawyer can assess correction, a fresh application or challenge and the relevant deadline. An appeal or title dispute is separately scoped; it is not automatically included in a filing service.
