Wrongful Dismissal Claims in Georgia

Challenging dismissal in Georgia: legal grounds, delivery of notice, short deadlines, evidence and possible reinstatement or compensation.

Confidential assessmentConsultation language agreed in advanceFor urgent matters, call to check availability

Advokato helps employees assess and challenge an employer's termination of employment in Georgia. Agreed work may include a deadline chronology, review of the documents and legal ground, a request for written reasons, negotiations and court representation. State when and how you received the notice in your first enquiry. Scope, fees and availability are agreed before work starts.

The right route starts by assessing current law, facts, documents and deadlines together. This page provides a practical framework; an individual strategy is formed only after a confidential case assessment.

This is the general framework of Labour Code Articles 47–48. Probation and employment governed by special legislation may follow different rules. Actual dates must be calculated from the documents.

  1. Reasons request: Article 48(4) allows a written request within 30 calendar days of receiving the termination notice; the employer has 7 calendar days after submission of that request to provide written reasons.
  2. Court: generally 30 calendar days from receipt of the written reasons; if no reasons arrive within 7 days, 30 days from expiry of that period. Without a reasons request, 30 days from receipt of the termination notice — Articles 48(6)–(7).
  3. Notice and severance: the alternatives of 30 days plus at least 1 month's remuneration, or 3 days plus at least 2 months, apply only to Article 47(1)(a), (f), (i) and (n) grounds under Articles 48(1)–(2), not every dismissal.
  4. Ground and protection: examine the actual Article 47 ground, internal rules and possible discrimination; Article 17(4) disapplies Article 48 to termination during probation unless the contract provides otherwise.
  5. Remedies: where termination is declared void, Articles 48(8)–(9) provide for reinstatement, equal work or court-set compensation and a possible lost-earnings claim; neither the amount nor the outcome is automatic.

Procedure

How the matter is managed

  1. 01

Build the chronology: notice, actual receipt, request for reasons and response; check the next action and deadline with a lawyer.

  2. 02

Assess employment status, the contract, probation or a special regime, the termination ground, procedure and potentially protected circumstances.

  3. 03

Organise evidence and remedies; under the agreed engagement, prepare a reasons request or dispute letter and an assessment of claimed amounts.

  4. 04

Assess negotiations and any settlement text while keeping the court-filing deadline under review.

  5. 05

Where needed, agree separately on the claim, evidence submissions and representation; appeals and enforcement depend on the engagement scope.

Documents

Initial checklist

  • Initial enquiry: employer name, role, start and termination dates, objective and the exact date you received notice.
  • Employment agreement and amendments, job description, applicable internal rules and any collective agreement.
  • Termination notice/order, written request for reasons, response and evidence of delivery for each document.
  • Warnings, appraisals, disciplinary records, emails and chats with relevant dates.
  • Payslips, bank records, final settlement, severance received and information needed to calculate the claim.
  • A list of relevant circumstances and witnesses; share sensitive files only as necessary through a channel agreed with the lawyer.

Risks

Common mistakes

  • Counting from the last working day alone and overlooking when notice was received.
  • Assuming negotiations, an inspection complaint or an online enquiry automatically protects the court deadline.
  • Signing a resignation, settlement or waiver before assessing its effect.
  • Losing relevant messages or accessing another person's systems without authority to obtain evidence.
  • Expecting automatic compensation without examining the legal ground, exceptions and the court's assessment.

Typical scenario

From facts to an action plan

Hypothetical example: an employee receives a redundancy notice by email and requests written reasons. The assessment covers delivery of the notice and request, the actual redundancy rationale, selection records, notice and severance paid. A possible settlement and the court deadline are considered together; the example promises no particular result.

FAQ

Direct answers to practical questions

Answers are general and do not replace individual legal advice.

01What will I receive from the lawyer?+

Depending on the agreed stage: document assessment, an explanation of deadlines and options, a letter or claim and representation. Confirm whether a written opinion, negotiations, hearings, appeal and enforcement are included; an initial consultation alone does not engage every stage.

02What determines the fee and other costs?+

The quote depends on document volume, factual complexity, remedies, urgency, languages, negotiation and court stages. Confirm representation, appeals and enforcement separately. Translation, expert and any procedural costs and exemptions are assessed individually; no fixed professional fee is advertised here. Agree the scope and explanation of costs before work starts.

03How long will the matter take?+

Assessment and preparation timing is agreed against the files and availability. Negotiations, the court calendar, evidence collection and appeals affect the overall duration. The 30- and 7-day periods above concern legal actions, not a promise to finish the case in that time. Urgent availability needs confirmation.

04Am I guaranteed reinstatement or compensation?+

No. The ground, facts, deadlines and evidence must be assessed. If a court declares termination void, possible remedies are assessed under Articles 48(8)–(9). Statutory severance and sums claimed for unlawful termination are different; the effect of amounts already paid must also be considered.

05What if I was on probation or in public service?+

First identify the governing regime. For probation, check the Article 17(4) exception and the contract. Public service may involve different grounds or appeal procedures under special legislation. Do not transfer the general labour deadlines to such a matter without checking.

06How do I start, and what does submitting the form mean?+

Use this page's consultation link: briefly describe the dismissal, date received, your objective and available documents. Sending the form does not establish representation or suspend a deadline. Conflict checks, scope, fees and the next step need confirmation with the lawyer; agree a channel before sending confidential files.
