Student Mobility and University Transfer

Legal guidance for transfer between Georgian universities or programmes, student status and relevant decisions.

Confidential assessmentConsultation language agreed in advanceTiming agreed

Advokato can discuss a student's proposed transfer between Georgian higher-education institutions or programmes and help identify the legal and procedural questions raised by the individual's situation. Depending on the agreed engagement, work may include reviewing the student's records and the institution's published requirements, identifying the applicable decision and deadline, preparing an issues list or written request, and considering an appropriate challenge to a decision. Whether representation or a particular application is suitable depends on the institution, the decision and the applicable rules. A transfer, credit recognition or successful appeal is not guaranteed. Academic mobility and immigration status are different questions. An international student should separately check the effect of a change in study on residence, visa or other immigration permissions; that work can be referred to the immigration service. This service does not make decisions on behalf of a university or the education authorities, issue an official decision, guarantee a place or establish the student's legal status.

The right route starts by assessing current law, facts, documents and deadlines together. This page provides a practical framework; an individual strategy is formed only after a confidential case assessment.

Procedure

How the matter is managed

  1. 01

Start with the current and proposed institutions and programmes, whether the intended move is within or between institutions, your student-status situation, the decision or difficulty and any known deadline. Do not send a passport or academic record in the first message; agree a suitable channel for sensitive documents. After checking conflicts and availability, agree the work, language, deliverables, fee, likely timing and any representation separately.

  2. 02

The lawyer may ask for relevant enrolment or status records, transcripts and course descriptions, relevant institutional correspondence, decisions and notices, the programme and institution concerned and any published instructions or application evidence. Depending on the agreed scope, the output might be a document checklist, written issue assessment, draft enquiry, review of a refusal or advice on a possible next step. Credit recognition is decided through the applicable institutional process; a legal assessment does not itself award credits.

Documents

Initial checklist

  • First enquiry: institutions, programmes, status, issue and any known deadline; agree a channel before sending sensitive records.
  • Later, as relevant: enrolment or status records, transcripts, course descriptions, correspondence, decisions and application evidence.

Risks

Common mistakes

  • Assuming a place, credit recognition or an open registration window is guaranteed.
  • Not checking student status, institutional rules, notice of a decision or the applicable deadline.
  • Treating academic transfer as automatic immigration permission.

Typical scenario

From facts to an action plan

A student at a Georgian university wants to move to another programme but has received conflicting information about places and recognition of completed courses. After scope and fee are agreed, a lawyer could review the student's status and written notices, identify the current authority and institutional requirements to verify, prepare questions or a request for an explanation, and discuss possible next steps if a decision is issued. The example illustrates a review, not a promised transfer or admission.

FAQ

Direct answers to practical questions

Answers are general and do not replace individual legal advice.

01Which legal rules should be checked?+

The current Law on Higher Education, Article 43 provides for transfer to another higher-education institution from the second year under Georgian law and the receiving institution's charter. It separately addresses situations in which an institution is liquidated without a successor, loses authorisation or a programme ceases: in those cases the mobility right arises regardless of the study period. Special rules apply to some institutions and statuses. These provisions do not establish an individual place, an open application or satisfaction of all requirements. The applicable rules and deadlines depend on the transfer, student status, academic year, institution and programme. Government and ministerial measures changed during 2026. For example, Order 148/ნ of 30 October 2026 adds restrictions affecting announcements of mobility or internal mobility at state-founded institutions for certain programmes from the spring semester of 2026–27. It also addresses capacity and vacancies for a defined cohort and a narrowly defined transitional situation. It does not prohibit every transfer or automatically establish that an individual student qualifies. Check the current instruments, institution-specific rules and announced application dates before acting.

02When is registration or a challenge possible?+

The official education-management mobility portal displays cycle-specific information. A completed application window should not be presented as a current opportunity, and future dates, charges, programme availability or registration status should be confirmed directly before making plans. If a decision has already been issued, preserve it and the date and method of notification; the available remedy and any deadline must be assessed for that decision and body.

03How are timing and fees determined?+

The quote depends on the complexity of the records, institutions involved, applicable legal questions, language, urgency and whether written submissions or representation are requested. Timing depends on complete instructions and the institution's and authority's response; official processing or registration charges, if any, are separate. Request a consultation to agree scope and fees before work begins.
