Civil Appeals

Assess an existing first-instance civil judgment, the right to appeal, the deadline and grounds; prepare an appeal or a response with an agreed representation scope.

Advokato can assess a first-instance civil judgment for a party considering an appeal or responding to one, after checking conflicts and availability. We review admissibility, service dates, the case file, legal and factual errors, evidence and costs. Agreed outputs can include a deadline and merits assessment, an appeal or response, supporting motions and hearing representation. Acceptance, suspension of enforcement and a favourable judgment are not guaranteed.

The right route starts by assessing current law, facts, documents and deadlines together. This page provides a practical framework; an individual strategy is formed only after a confidential case assessment.

These are general civil appeal rules under Georgia's Civil Procedure Code. Default judgments, procedural rulings, cassation and special proceedings need a separate route and deadline check; criminal and administrative appeals are outside this page's scope.

  1. Admissibility: Articles 364–366 identify the appeal route and limits. In a property-related dispute, Article 365 generally requires the value of the challenged part to exceed GEL 2,000. Do not apply that threshold mechanically to non-property claims or treat an ordinary appeal as the remedy for every default judgment.
  2. Deadline: Article 369 sets a 14-day appeal period that cannot be extended or restored. The trigger depends on lawful delivery, announcement of the reasoned judgment when the entitled person is present, and Article 259¹ collection rules. Review the actual court record; the day you personally read a copy is not necessarily the start date.
  3. Collection: under Article 259¹, a person present at, or duly informed of, the announcement generally must collect the judgment between days 20 and 30 after announcement of the operative part if intending to appeal; otherwise the appeal period runs from day 30. The provision also specifies persons for whom the court must arrange service. Check which rule applies before calculating the deadline.
  4. Filing and grounds: Articles 367–368 require filing through the court that delivered the judgment, identifying the challenged part, requested change, errors, supporting circumstances and evidence. Check signature, copies, appeal authority and fee evidence. A court's period for correcting defects is a separate procedural matter.
  5. Evidence and scope: Articles 380–382 restrict new evidence that could have been produced earlier but was omitted without a valid reason. Article 381 bars changing or increasing the subject of the claim or introducing a counterclaim on appeal; this differs from a respondent's procedural response. Build the argument from the existing record and justify admissible additions.
  6. Enforcement: under Article 375, admission of an appeal affects the entry into force of the challenged part. A judgment ordered for immediate enforcement requires a separate assessment of possible suspension by the appellate court. Do not assume that sending an appeal or contacting a lawyer automatically stops enforcement.

Procedure

How the matter is managed

  1. 01

Start with the court, case number, your role, decision type, announcement and service dates, any existing deadline and the change you seek. Agree a suitable channel before sending the file.

  2. 02

Check the full judgment, proof of service or collection, the first-instance record and authority to act. Confirm the procedural route, deadline, scope, consultation language and fee.

  3. 03

Map each challenged finding to a legal or factual error, the requested remedy and the relevant record. Assess new evidence and explain why it was not produced earlier.

  4. 04

Prepare the agreed appeal or response, attachments and motions. Check the proper filing court, signature, representation authority, copies and state-fee payment or relief request.

  5. 05

Where representation is agreed, retain filing evidence, track court notices and correction deadlines, prepare for hearings and report the result. Cassation, enforcement and separate claims need their own scope.

Documents

Initial checklist

  • Initial enquiry: court and case number, your procedural role, a short description of the dispute and all known announcement, service and response dates. Do not post identity numbers or the full court file in a public form.
  • Through the agreed channel: the complete reasoned judgment, operative part, summons, delivery receipts, electronic notices and records of collection or attempted collection.
  • Claim, defence, amendments, motions, hearing records and the evidence submitted at first instance; identify disputed findings and the precise change requested.
  • Any proposed new evidence, when it became available and the reason it could not be submitted earlier; the opponent's appeal and the court's response deadline if applicable.
  • Existing authority or power of attorney, fee-payment or fee-relief documents and any immediate-enforcement order or enforcement notice. Confirm translations and additional authority only as needed.

Risks

Common mistakes

  • Waiting for a postal copy without checking the rules on announcement, service and collection of the judgment.
  • Treating an appeal as a new claim or assuming all omitted evidence will be accepted.
  • Challenging the whole judgment without specifying the remedy, disputed amount and substantiated errors.
  • Assuming an enquiry stops a deadline, an appeal guarantees a stay, or a court correction period extends the appeal filing deadline.

Typical scenario

From facts to an action plan

Hypothetical example: a business disputes a payment judgment and believes the court overlooked a receipt. The lawyer checks the appeal deadline and challenged amount, locates the receipt in the first-instance file, and assesses the finding and requested remedy. If the receipt is new, the reason for its earlier absence must be assessed. This is an illustration, not a client result or a promise that the appeal will be admitted or succeed.

FAQ

Direct answers to practical questions

Answers are general and do not replace individual legal advice.

01What will the lawyer deliver?+

The engagement can cover a reasoned assessment of admissibility, deadlines and prospects, an appeal or response with a document index, relevant motions and hearing representation. We agree which stages are included and identify weaknesses and missing evidence. A legal assessment is not a success guarantee.

02What are the fees and separate court costs?+

Professional fees depend on file size, issues, urgency, languages, hearings and agreed motions. A written scope and quote follow assessment. Article 39 generally sets a property-related appeal fee at 4% of the dispute value, at least GEL 150, capped at GEL 5,000 for individuals and GEL 7,000 for legal persons; the general non-property appeal fee is GEL 150. Magistrate-jurisdiction cases use half the applicable paragraph 1 rate. Special categories and exemptions or relief under Articles 46–48 must be checked. Court fees, translation, experts and possible opponent-cost liability are separate; no fixed professional price is promised.

03How quickly must I act, and when will the case finish?+

Provide the judgment and announcement/service history promptly. The general Article 369 period is 14 days and is not extendable or restorable; the start date needs a file-specific check. Preparation time depends on the record and agreed availability, while court scheduling, service, evidence and further proceedings affect the outcome date. An enquiry or appointment request neither suspends a deadline nor confirms representation.

04Can an expired appeal deadline simply be restored?+

Article 369 expressly excludes extension and restoration of its appeal period. A dispute about whether lawful service occurred or the period began is a different issue that requires evidence. Do not assume a missed deadline can be repaired by a general restoration request; the precise decision and any different available procedure must be assessed.

05Can you help the respondent or with a different type of challenge?+

A respondent can seek a scoped review of the opponent's appeal, preparation of a response and representation within the court-set period. Default judgments, private complaints against procedural rulings, cassation, special proceedings and enforcement require separate assessment. New contract drafting, routine contract review and counterparty investigations are distinct services.
