Judgment Enforcement

Move from a Georgian court judgment to a practical enforcement plan, with the correct documents, a realistic cost assessment and defined representation.

Confidential assessmentConsultation language agreed in advanceScope and timing agreed after assessment

Advokato can help a creditor assess and pursue enforcement of a Georgian court judgment, subject to a conflict check and agreed scope. We check whether the decision is enforceable, reconcile the unpaid obligation, prepare the application and represent you in the agreed enforcement steps. A court win does not itself produce payment: recoverable assets, competing claims and procedural obstacles matter. The bailiff exercises compulsory powers; the lawyer prepares requests and protects your procedural position.

The right route starts by assessing current law, facts, documents and deadlines together. This page provides a practical framework; an individual strategy is formed only after a confidential case assessment.

The current Georgian Law on Enforcement Proceedings governs the core steps. The checks below focus on an ordinary Georgian judgment; special acts, immediate enforcement and non-monetary obligations require their own assessment.

  1. Enforcement basis: Articles 20 and 25 generally require the original enforcement writ and the creditor's written application, with statutory exceptions. Check that the parties and obligation match the enforceable decision before submitting the file.
  2. Recovery steps: Article 25¹ identifies commencement, attachment, auction and transfer of money as stages in monetary enforcement. The actual route depends on available assets and the case; not every debt requires an auction.
  3. Case participation: Article 18 permits parties to review enforcement materials and obtain necessary information, subject to confidentiality restrictions, and to settle. A lawyer's mandate does not create unrestricted access to bank or tax secrets.
  4. Challenging a bailiff's action: Article 18 provides 15 calendar days from the action for a complaint to the NBE chairperson, or one month from the action for a direct court challenge. A chairperson's complaint decision may be challenged within one month of service. These are enforcement-action deadlines, not deadlines for appealing the underlying judgment.
  5. Suspension and payment: under Article 18³, an NBE complaint does not automatically suspend the challenged action; suspension needs a separate decision. Article 38 regulates official enforcement fees, advances and exemptions. Confirm the applicable category and current payment instructions before paying.

Procedure

How the matter is managed

  1. 01

Send a short summary: your role, court and decision date, unpaid amount or other obligation, existing enforcement case number and urgent dates. Agree the consultation language, contact method and secure document channel.

  2. 02

Check the judgment, enforceability, enforcement writ, parties and any stay or earlier proceedings. Agree deliverables, fees and who will supply missing documents before filing.

  3. 03

Prepare the enforcement application, representation authority and supporting file. Reconcile payments and identify the applicable official fee or advance and any exemption.

  4. 04

Present lawful, relevant information about assets and request appropriate enforcement steps. Review notices and available case materials; record actions, obstacles and deadlines without promising access to confidential bank or tax records.

  5. 05

Monitor agreed stages, assess settlement proposals and any necessary challenge, then reconcile recovered sums and outstanding costs. Further litigation, auction disputes or a separate recognition procedure need a defined scope.

Documents

Initial checklist

  • Initial enquiry: a brief account of the decision, what remains unpaid or unperformed, your role and key dates. Keep identity numbers, bank details and sensitive case files out of the initial message.
  • For the agreed assessment: the judgment or other relevant decision, evidence of its enforceability and the enforcement writ where required; include corrections and any suspension order.
  • Existing enforcement notices, case number, applications, bailiff correspondence and dated evidence of actions or service of decisions.
  • Payment records and an itemised remaining balance consistent with the judgment. Identify disputed interest, partial payments or proposed settlement terms.
  • Necessary party identification and representation authority, plus lawfully obtained information about relevant assets or security. Confirm the original/certified-document requirements and payment-account details through the agreed channel.

Risks

Common mistakes

  • A judgment against a company does not automatically authorise recovery from its shareholder, director or another person's property.
  • An incorrect writ, missing enforceability evidence or failure to deduct payments can obstruct or distort enforcement.
  • No available assets, prior security, other creditors, insolvency or disputed ownership may reduce or delay actual recovery.
  • Negotiations or a complaint do not automatically stop enforcement. Informal payment promises can leave a deadline running.

Typical scenario

From facts to an action plan

Hypothetical example: a supplier holds an enforceable Georgian judgment against a company, but part of the debt has already been paid. The lawyer reconciles the balance, checks the writ and prepares the enforcement file, using lawful information about the company's assets. If an asset is encumbered or belongs to a third party, recovery prospects and next steps must be reassessed. The shareholder's personal property is not treated as company property. This illustrates the work; it is not a past client result or a collection guarantee.

FAQ

Direct answers to practical questions

Answers are general and do not replace individual legal advice.

01What will I receive from the lawyer?+

The agreed work can include an enforceability and document checklist, reconciled balance, written action plan, enforcement application and copies of submissions. Representation can include reviewing notices, requesting steps, monitoring progress and reporting obstacles. Define whether settlement negotiations, complaints, court proceedings and auction-related work are included.

02What affects the cost?+

Legal fees depend on the obligation, number of parties and assets, file condition, existing proceedings, urgency, negotiation and challenge scope. Official enforcement fees and any creditor advance are separate from the lawyer's fee and may depend on statutory exemptions and the case category. Valuation, translation, registry information and other necessary third-party costs are identified separately. Agree scope and a written quote first; no fixed total or recovery guarantee is assumed.

03How long does enforcement take?+

We confirm preparation timing after checking the file and availability. Actual recovery depends on enforceability, assets, notifications, objections, sale procedures, other creditors and possible suspension or insolvency. No universal collection date is reliable. Give us the dates of the bailiff's action and receipt of any decision immediately; requesting a consultation does not pause a deadline or confirm an appointment.

04Can you help if I only have an unpaid invoice?+

A disputed invoice and an enforceable judgment are different starting points. We can assess the appropriate debt-recovery route under a separate scope. Do not assume that an ordinary invoice can be submitted as a court enforcement writ. If enforcement is already directed against you, request an assessment of the notice, balance and challenge deadline; conflicts are checked before accepting representation.

05What if the judgment was issued abroad?+

A foreign judgment may first require recognition and permission for enforcement in Georgia. That assessment, including jurisdiction, service, finality and translation, is a separate service. A foreign decision or arbitral award must not be treated as automatically equivalent to an enforceable Georgian court judgment.
