Recusal of a Member of the NBG Board: Conflict of Interest and Distinction from Termination of Authority

The notice of removal from participation in Board decisions does not equate to termination of membership or proof of a crime. Legal assessment requires the full scope of the act.

According to Imedi's evening report of 9 October 2026, the Board of the National Bank decided that Nana Keinishvili would not participate in the development and adoption of Board decisions until the completion of the investigation. The report relies on the Bank's explanation. This is a different administrative development from earlier reports regarding the investigation; termination of membership is not confirmed by this text.

When can a member of a collegiate body be recused?

Article 92 of the General Administrative Code defines the grounds for inadmissibility of participation, including personal interest in a case and ownership of shares in a relevant enterprise. Article 93 establishes the procedure for considering the issue of recusal; a collegiate body decides on the recusal of a member without the participation of that member. The specific ground must relate to the case under consideration and a confirmed circumstance.

Article 13 of the Organic Law on the National Bank addresses conflicts of interest for Board members, including restrictions on partnership with representatives of the financial sector. Administrative recusal, incompatibility of office, and criminal culpability are independent questions. The initiation of one procedure does not provide an automatic answer to the others.

What should be evident from the full text of the decision?

The legal basis of the act, the exact scope of participation restrictions, duration, and conditions for subsequent review need to be clarified. The procedure of the Board meeting is also important. Based solely on a media headline, we cannot determine whether the restriction applies to all issues or specific decisions, and in what form it has been formalised.

What does recusal not prove?

The presumption of innocence under the Constitution of Georgia and the guarantee of Article 6 of the European Convention remain in force in criminal assessments. The Convention is binding on Georgia. To verify the legality of the recusal, the act and an assessment of the relevant legal protection procedure are required; it is impermissible to prematurely declare the outcome of the investigation and the culpability of the person based on this decision.
