Railway Workers' Salary Increase Plan: Who Does the Announcement Concern and When Does the Amount Become Due?

The Minister's announcement concerns employees working directly on the railway line. The specific amount of the salary, the effective date, and relevant documents still need to be checked separately.

On 9 October 2026, the Minister of Economy, Mariam Kvrivishvili, announced that from 1 January 2027, the remuneration of employees working directly on the railway line would increase by approximately 20%. The Imedi report does not provide a full list of employees, the employer's corresponding decision, or amended contracts. The announcement should not be interpreted as an identical increase for all railway workers.

Salary is an essential term of the contract

Article 14 of the Labour Code lists job description, salary, any allowances, and payment procedure as essential terms. Article 20, Part 2 links changes to essential terms to an agreement between the parties, while cases caused by changes in law are assessed under separate rules.

The legal significance of a public announcement must be assessed according to its content, the authorised person, existing contracts, and subsequent employer acts. The report itself does not indicate a new accrual for a specific employee. It is necessary to clarify whether the increase applies to the basic salary or other components, and which positions are included in the relevant group.

What needs to be checked before January 2027

An employee may request a written clarification of the conformity of their position, the effective date, and the new remuneration. The individual or collective agreement and the salary calculation procedure must be checked. The promise of approximately 20% does not automatically establish the same exact amount for everyone, the amount received after tax, or an increase in all allowances.

When does a payment dispute arise

Article 41 of the Labour Code links the form and amount of remuneration to the contract and requires payment at least once a month. The same article specifies a daily penalty of 0.07% for delay, with corresponding exceptions. This rule applies to the assessment of already due and delayed amounts; a potential future increase cannot be considered a delayed salary today.

In a dispute, the valid contract, the amendment document, the period of work performed, and records of accrual and payment will be important. Different remuneration for groups with different work does not in itself prove discrimination; possible differences related to prohibited grounds must be assessed separately. Based on this report, we have no grounds to conclude such a violation.

The announcement concerns a future change. Specific rights and means of claim are assessed based on actual employment documents and performance. A general labour recommendation from an international organisation cannot replace a specific 20% obligation to be fulfilled by the employer. The current legal framework is explained here as of 9 October; changes effective by 2027 must also be re-checked.
