A DNA report can be relevant evidence, but it is neither universally required nor a universal solution in a surrogacy file. Establish who wants it, what fact it must address and what process the recipient accepts before ordering a test. Then plan lawful consent, identity verification, documented sample custody and report authentication. Genetic relationship, legal parentage, birth registration, nationality and travel rights remain different questions. This guide concerns organisation of legal evidence, not instructions for taking samples or promotion of a laboratory.

Define the question before ordering a test
The first question is not which laboratory works fastest. Identify whether evidence is for a Georgian court, an administrative file, a Chinese consular assessment or private family knowledge. These purposes do not share one procedure or legal effect. Preserve the recipient’s request or court order in the form received.
The Chinese Embassy’s public first-issuance checklist mentions birth or relationship evidence and possible additional material. It does not establish that every newborn must undergo DNA testing or that any private report will be accepted. If an intermediary relays a request, ask for its official basis or a way to confirm it with the recipient. Write the evidential question in one sentence before ordering services. Demonstrating a specified genetic relationship differs from asking an authority to recognise a person as a legal parent.

What genetic evidence can establish
Genetic testing addresses a biological relationship between the tested people within the limits of the method used. It does not establish that an agreement was timely, all required parties participated, consent was valid or a complete registration file was submitted. Georgian health and registration rules have their own conditions. Donor circumstances should not be reduced to one sentence in a test report.
Chinese Nationality Law Article 5 involves birth location, parental nationality, settlement abroad and foreign nationality at birth. A test does not prove every part of those facts. Civil Code Article 1073 concerns a framework for parentage claims in court; it does not predetermine every overseas-surrogacy case. Explain the report’s purpose without calling it a guarantee of citizenship, a passport or recognition. The competent authority must assess the legal question with the other evidence.

Questions for the receiving authority
Confirm which people need to be tested, the precise expert question, where identity checks may occur and how the result must be delivered. Ask whether the recipient has particular requirements for the institution, witness, report format or translation. These are questions to resolve, not a universal mandatory checklist.
Give the written response to the laboratory when agreeing the service. If it is unclear, ask whether the specific proposed arrangement is acceptable. “International report” or “embassy-ready” does not establish the recipient’s agreement. A response from one body is not a rule for another. For litigation, review procedural requirements separately with counsel. Technical ability to run a test and legal acceptance of the resulting evidence are different matters, best aligned before the test rather than after a family has paid and travelled.

Verify the provider without relying on promises
Ask for the laboratory’s legal identity, relevant authority to operate, responsible report signatory and exact service description. If the recipient requires accreditation or another recognition, verify the required scope and current status in the appropriate official register. This guide assumes no single foreign accreditation is universally required in Georgian or Chinese cases.
Determine whether the institution performs the work itself or sends samples to another provider. Subcontracting is not automatically improper, but identity, responsibility and data movement must be clear. Define the report recipient and clarification route in the service agreement. Replace “guaranteed acceptance” with verifiable information about what the actual authority confirmed. A promised conclusion before analysis does not establish evidential quality. The family should be able to contact the genuine report issuer independently, rather than relying entirely on an intermediary’s account.

Consent and representation of the child
Establish who can lawfully act for the child before any sample-related step. Separate parent, caregiver and agency roles. Patient Rights Law Article 22 lists genetic testing among written informed-consent circumstances; the actual legal framework of the service and representation of the child require attention. An adult’s consent concerning their own sample does not automatically authorise a child’s sample.
The form should explain purpose, participants, recipients and permitted use in understandable language. Do not sign before obtaining an explanation you understand. Do not use secretly obtained material or another person’s belongings as if identity had been verified. Parental disagreement or a representative’s conflict of interest requires legal and, where necessary, official assessment. This guide does not authorise coercing anyone to undergo testing or treating refusal automatically as proof of a particular parental status.

Identity before the sample
A central evidential question is whose material was examined. A high numerical result cannot answer that if participant identification is uncertain. Check how each participant connects to an identity document, birth record or other evidence accepted by the recipient. The precise verification method should follow the recipient’s and authorised provider’s requirements.
Prepare a correspondence table for Chinese, Latin and Georgian names, including links between old and new passports. A family table does not replace official identification, but exposes discrepancies early. For twins or several children handled on the same day, every record must connect to the individual child; one sibling’s report cannot stand for another. Resolve identity-field inconsistencies before circulating the result to institutions. Keep sufficient evidence of the check without creating unnecessary copies of sensitive identity documents for unrelated parties.

Document the sample’s custody
The custody chain should answer who verified identity, who received the material, when it moved to another custodian and how it connects to the report. The required format depends on the case. Check identifiers, dates, responsible people and receipt records. This is a documentation review, not instruction in sample collection or encouragement to collect material informally.
Where material moves between institutions, establish who records each transfer and who can explain a gap. A missing step must not later be presented as documented merely because a family member supplies an explanation. Do not open or alter a protected package on your own initiative. International movement of biological material may involve specific requirements; this guide does not recommend ordinary postal shipment. The responsible organisation should confirm a lawful and accepted route for the actual journey.

Participants in different countries
If one participant is in China and another in Georgia, verify the identity and collection arrangements in each place. A common form supplied by one laboratory does not establish compliance in both countries. Identify the institution issuing the final opinion and how the separately obtained materials are linked to one case. Agree the process first; correcting it later may require repetition.
Ask whether the recipient needs direct delivery from the issuer, a particular identification record or further verification. Do not assume a family-selected courier or exchange of samples between participants is acceptable. Explain timing, possible repetition and responsibility for extra charges. Cross-border data disclosure is also a separate legal question. A consent phrase allowing “all purposes” is not a substitute for identifying transfer arrangements and responsible parties.

Read the report and verify its issuer
Check the report’s case number, participant identifiers, dates, provider, responsible signatory and question addressed. A single numerical result is not the complete report. Identify what material was examined, stated limitations and the actual conclusion. Ask the expert to explain technical terms rather than replacing them with your own legal interpretation.
If an intermediary delivers the report, independently verify that it originated from the named institution. Use a contact obtained from an official source rather than only the number accompanying the message. Resolve differences in names, numbers or pages with the issuer. Retain the connection and explanation if a corrected version exists. An extract may be insufficient where the recipient needs the full identity or methods section. Equally, avoid spreading raw genetic data beyond what the legitimate purpose requires.

Court evidence and expert opinion
Under Georgian Civil Procedure Code Article 105, evidence has no predetermined force and the court assesses it with the other material. Article 162 addresses expert examination and the procedural stages for party-obtained opinions. Possessing a private report does not mean it can be submitted at any time without explanation or that it will decide the case automatically.
Work with counsel on the disputed fact, submission method and whether a particular court order is needed. Do not ask an expert to decide nationality or legal parentage in place of the court. Chinese Civil Code Article 1073 belongs to its own parentage litigation framework; it does not automatically resolve the use of a Georgian private report in China. Forum, admissibility, authenticity and evidential weight need separate assessment. No automatic foreign recognition or uniform outcome is promised.

Translation and authentication after the report
A translation must preserve participant roles, the question, the scope of the conclusion and limitations. “Genetic father” and “legal parent” must not become interchangeable because the family wants a shorter phrase. A qualified or conditional scientific conclusion must not turn into an unconditional legal guarantee in translation.
The authentication route depends on the document’s legal character and any relevant public certification; private laboratory reports do not all follow one direct apostille route. Confirm the form with the recipient and competent authentication body. The Chinese Embassy explains that apostille does not secure substantive acceptance. It cannot repair unverified identity, broken custody or the wrong question. Review the report and intended use before purchasing translation and authentication. A package prepared for another family or purpose is not automatically suitable for this file.

Protect genetic information
Georgia’s Personal Data Protection Law defines genetic data and protects genetic data processed for unique identification as a special category. Connect each disclosure to the case purpose: who receives the report, which parts are retained and who may forward them. Consider the child’s interests separately because the information may remain significant long after the current application.
Keep the complete report under restricted access and use a case number and necessary minimum in routine messages. Avoid posting full passports, reports and child photographs together in group chats. Ask the laboratory about retention, legal storage obligations, possible deletion and transfers. Immediate deletion is not always available, especially where legal duties or a pending dispute require preservation. If information reaches the wrong recipient, stop further circulation, preserve factual details and promptly clarify the response with the responsible organisation.

Hypothetical example and file assessment
In a hypothetical case, a family obtained a private report from material collected at home, then an authority requested reliable proof of participant identification. Adding an apostille does not establish whose material was tested. Clarify the request and ask the provider what verification actually occurred. A new agreed process may be necessary, but that decision follows review of the complete file.
