For a child born in Georgia, assess Chinese nationality using the facts that existed at birth. Article 5 of China’s Nationality Law connects the analysis to parentage, relevant parental Chinese nationality, settlement abroad and foreign nationality acquired at birth. It does not itself resolve parentage following surrogacy. Start with an evidenced chronology and ask the competent authority to clarify uncertain facts. Choose the question before collecting evidence
Begin with one precise question: which facts must the Chinese authority assess to decide this child’s nationality at birth? Taking the baby to China combines parentage, document issuance, border entry and later registration. Write down the decision you need, the applicant and the intended decision-maker. Match each record to a particular fact. A current parental passport may establish present identity while leaving earlier nationality or residence status unresolved.
If parentage is unsettled, mark that issue explicitly. An agency promise or a contract using the word parent cannot substitute for the competent authority’s assessment. A useful working table has columns for the fact, supporting record, relevant date, issuing body and unanswered question. This is a preparation method, not an official application form. It helps separate a missing document from a genuine legal uncertainty and prevents expensive translations of papers that do not address the actual issue.

Read Article 5 as a connected test
Article 5 concerns birth outside China. Its initial rule refers to Chinese nationality of one or both parents; its exception combines the relevant parent’s settlement abroad with the child having foreign nationality at birth. Read those elements together. One Chinese parent is not a complete individual analysis. Equally, possession of any foreign residence card is not sufficient to announce that a child cannot have Chinese nationality.
Give every element its own evidence. Identify the parental relationship relied upon, nationality on the birth date, the foreign status held and the basis on which the child might have acquired another nationality. Where an element remains disputed, leave the conclusion open. The statute does not authorize replacing an unknown fact with a favourable assumption. Ethnicity, language and a family’s intended home do not replace nationality evidence. A careful assessment records the unresolved branch of the test instead of producing a simplistic yes-or-no chart.

Resolve the parentage foundation
In a surrogacy file, distinguish genetic connection, the person who carried the pregnancy, contractual roles and the parents named in an official record. Those terms do not have identical legal effects for every institution. A Georgian birth certificate is important evidence, but Article 5 does not declare every foreign certificate conclusive for every Chinese purpose. The Embassy’s 2026 checklist requests birth or relationship evidence and allows supplementary material.
Explain which relationship each record supports. If there is a court decision, identify its operative findings and procedural status; do not attribute a nationality decision to a judgment addressing a different issue. Chinese Civil Code Article 1073 supplies a general framework for specified parentage disputes, not a predetermined overseas-surrogacy outcome. Obtain Chinese legal advice when that issue is material. Even genetic testing should answer a recipient’s identified evidential question. A test selected solely because an intermediary recommends it may leave the actual legal relationship unresolved.

Build a birth-date snapshot
Centre the chronology on the child’s birth, not contract signature, a consular appointment or a booked flight. For each relevant parent, record passport issuance and replacement, any acquisition of another nationality, the beginning and end of residence statuses, application dates and effective decisions. Link each event to its issuer. A later-issued document may evidence an earlier status; its printing date and the legal commencement date need not coincide.
Describe changes near the birth date carefully. For example, a residence approval letter might precede delivery of the physical card. Do not assume collecting the card is legally decisive. Preserve the decision, any official explanation and the translation, then submit the uncertainty for assessment. Distinguish established facts, personal recollection and matters awaiting verification in your working chronology. This reduces accidental inconsistency between the initial declaration and a later explanation and allows an adviser to focus on the date that actually matters.

Residence evidence and settlement abroad
Do not convert settlement abroad into an improvised rule treating all visas and residence permits alike. A visitor’s stay, study permission, temporary residence and permanent residence describe different factual and legal situations. Ask the competent authority how the particular status affects the nationality analysis. The Embassy’s request for foreign residence documents or visas held at birth explains the need for historical evidence; it does not publish a universal result for every foreign category.
Preserve both sides of a card, its underlying decision, validity dates and any change-of-status record. Where a local status term has no straightforward Chinese equivalent, attach an issuer’s description rather than asking a translator to choose a favourable label. Tax payments, an address or overseas employment may help explain chronology but are not interchangeable with an official status determination. State why each supplementary paper is relevant so that the classification issue remains visible within the file.

Check foreign nationality at birth separately
Birth in Georgia, a Georgian birth certificate and Georgian citizenship are different matters. This guide does not determine entitlement under any foreign nationality law. For Article 5, investigate whether the child had a foreign nationality at the moment of birth under the relevant country’s rules and the actual circumstances. The absence of a foreign passport does not necessarily answer that question. Nor does a later passport issue date establish when nationality arose.
If another nationality may be relevant, identify the country, connecting fact and material date. Obtain an appropriate status explanation from the relevant authority when needed for the assessment. Do not create a categorical declaration of no foreign nationality while the underlying facts remain unknown. First establish how the authority expects uncertainty to be disclosed or investigated. Getting this distinction right helps maintain an accurate declaration and preserves the family’s ability to explain why a foreign document was or was not supplied.

Hypothetical example: a card issued later
Consider a fictional family whose child was born in June. One parent received a foreign residence card in July after applying in March. An intermediary says the July printing date settles the nationality issue. That conclusion is premature. Establish which decision created the status, its effective date, the parent’s earlier status and how the Chinese authority assesses that category. Parentage and the child’s possible foreign nationality at birth still need independent consideration.
Organize the March application, approval notice, July card and a neutral chronology. Avoid labelling any item proof of guaranteed Chinese citizenship. If an approval notice is missing, identify its custodian and how a copy can be obtained. This example is hypothetical and predicts no individual result. It demonstrates why reading a visible card date is less reliable than investigating the underlying decision. The objective is an answerable question supported by records, not a favourable story assembled from selective dates.

Prepare a truthful nationality declaration
The Embassy’s first-issuance checklist includes a nationality-status declaration. Nobody should sign wording they do not understand or facts they have not checked. Compare the declaration with the birth record, passports, historic visas and residence documents. If names appear in different scripts, prepare an identity cross-reference while preserving the originals. A substantive error must not be hidden by a conveniently altered translation; correction may require the issuing authority.
If an earlier message contained a wrong date or status, prepare a transparent correction: the earlier statement, accurate information, supporting source and reason for the mistake. An explained revision preserves a comprehensible history. Where a form appears to demand certainty about an unresolved fact, ask how uncertainty should be disclosed. A lawyer can structure an explanation but cannot turn an unknown fact into verified evidence. Treat the declaration as substantive, rather than a document an intermediary completes and the family signs without reading.

Understand the non-recognition rule
Article 3 states that China does not recognize dual nationality for Chinese nationals. It is not a reason to hide a passport or choose which inconvenient facts to disclose. Different countries may characterize a person’s status differently; complete information allows the Chinese authority to address that situation. Record the existence of documents, their use and the date nationality arose as separate matters.
If a family member acquired another nationality, preserve its official basis and date. That may affect the relevant parent’s status assessment. Continued physical possession of an old Chinese passport does not answer every legal question. Do not renounce a nationality or change residence status solely because an intermediary promises an easier result for the child. Those decisions have their own consequences and need appropriate individual advice. The purpose here is to establish accurate facts, not prescribe a strategy for acquiring, retaining or relinquishing citizenship.

Create a targeted consular evidence file
Start with a neutral one-page account: the child’s birth date and place, adult roles, existing official records and specific unanswered questions. Add a numbered index and chronology. Keep passports, birth evidence and historical residence evidence in separate groups. Translation should preserve names, dates, issuing bodies and exact status terminology. Confirm translation requirements before commissioning work.
An apostille addresses official origin and cannot replace a nationality or parentage assessment. The Embassy’s authentication guidance expressly warns that authentication does not guarantee Chinese acceptance. Establish which record and format the recipient needs before paying for authentication. A bulk dump of medical records is not a substitute for a targeted answer. Do not place genetic data, health history or complete passport scans in a public contact widget. An initial request for assistance can state dates, document categories and the problem in general terms, with sensitive evidence supplied later through an agreed channel.

Keep later decisions separate
A nationality assessment does not complete every later process. First issuance of a passport or travel document has its own procedure. After issuance, the actual route, transit and entry requirements still need checking. Household registration in China involves another authority. Article 24 of the Ministry of Public Security working rules addresses foreign-born persons possessing Chinese nationality and describes evidence and verification mechanisms. It does not say every travel-document holder automatically receives household registration.
Give each stage a responsible person and next action. Do not label household registration approved without a decision. An authenticated birth certificate should not be labelled parentage recognized in China. Accurate status labels reduce confusion among family members, lawyers and intermediaries. They also help the family manage accommodation, care arrangements and financial contingencies while one decision is complete and another remains outstanding. Keep copies of each outcome because later recipients may need to understand exactly what was assessed.
The Chinese civil-law and hukou discussion on this page concerns Mainland China. Hong Kong and Macao document, registration and relevant nationality-application arrangements need separate assessment; territorial operation of the apostille route does not unify those matters.

Ask for a focused legal review
