Establish what has actually happened to the agency

A closed office, unanswered telephone or announcement in a chat group does not establish the company's legal status. Identify the exact contracting entity, its registration number, registered address and current authorised representative. Compare the contract, invoices and payment recipient, because a trading name may have been used by more than one entity. Obtain current registry information and preserve the date of the check. Distinguish a temporary interruption from a registered corporate change.

If formal liquidation or another proceeding exists, identify the person authorised to act and the relevant published information. Do not assume that a former employee can bind the company or release all records. Equally, a company that remains registered may have stopped operating in practice, so registry status alone does not ensure that urgent applications are being handled. The purpose of this first check is to find a legally and operationally reliable contact, not to infer that every outstanding obligation has vanished.

Separate immediate continuity from the money dispute

List the next actual deadline and the person currently handling each task. A pending registry response, an appointment, a supplementation request and a child's daily care need different attention. Obtain copies of official notices rather than relying on the agency's calendar. Decide which actions can continue directly with the relevant institution and which require a new representative. If a child's immediate welfare is at risk, seek appropriate local assistance promptly and do not wait for the commercial dispute to be resolved.

A refund claim should be documented, but it is not a substitute for preserving the application file. The Chinese Embassy's first-document guidance makes identity and nationality verification case-specific; the disappearance of an intermediary does not create a guaranteed expedited route. Check lawful stay and practical care arrangements separately. Avoid promising a departure date to a replacement provider. A continuity plan should show what is known, what must be confirmed and who has authority to take the next step.

Map the actual holders instead of treating the agency as the archive

Divide the file into registry documents, notarial documents, clinic-issued material, private agreements, payments and correspondence. For each category, record the originating institution and the present holder. An agency may possess only copies or summaries. A public registry or medical institution may retain the authoritative record even when the agency's online folder is inaccessible. Identify legitimate routes to those holders before paying someone to reconstruct the entire file.

For a repeated Georgian civil-registration certificate, the SDA publishes applicant categories and a notarised-authority route for another person. Eligibility must be established; the new coordinator does not gain access merely by volunteering to help. Other documents follow their own access rules. Keep separate requests for originals, authorised copies, status information and explanations of missing items. This prevents a single vague demand for everything from obscuring the most urgent and obtainable records.

Send a specific preservation and handover request

Address the request to the identified entity and authorised contact through a traceable channel. State the contractual relationship, the applicant's capacity and the documents sought. Ask the holder to preserve relevant originals, electronic files, attachments, application references and delivery records pending a lawful handover. Identify any particular risk, such as account closure or staff departure, without making unsupported allegations of theft or fraud.

Where the relationship is properly classified as a mandate, Civil Code Articles 713–715 are relevant to information, continuing confidentiality and return of material received or obtained. Their application depends on the agreement and facts. Ask for a written inventory, the location of originals, the identity of any third-party custodian and a proposed transfer date. Explain which items are needed urgently and why. A preservation request does not itself compel compliance like a court order, but a precise request creates a clearer basis for further assessment.

Check who may deliver and who may receive

The person holding a folder physically may not have authority to transfer every document inside it. Confirm the outgoing representative's role, the receiving person's authority and the scope of the handover. If the file contains another adult's clinical information, the family's contract with the agency may not authorise unrestricted release. Ask for a lawful, scoped transfer rather than encouraging a former employee to copy the entire company drive into a personal account.

If a new representative is appointed, review the existing powers and notify relevant recipients where required. Authority to collect certificates should not be mistaken for authority to settle claims, waive rights or consent to medical actions. Verify the proposed replacement provider before signing

An announcement that another agency is taking over may describe a referral, a subcontract, a business sale or a formal corporate succession. Those situations do not have identical consequences. Obtain the new entity's details and a written explanation of what it proposes to assume. Ask whether it is accepting existing obligations, merely offering future services or collecting records as an authorised representative. Compare that explanation with any registered corporate event and the relevant contracts.

Do not sign a document described as a simple handover without reading releases, new fees, data permissions and dispute clauses. A new service agreement may add obligations without resolving the old company's responsibilities. Record what has been accepted and what remains disputed. If the proposed provider wants a complete sensitive file before explaining its role, ask why that scope is necessary. Operational convenience is not proof of legal succession or lawful entitlement to every family document.

Use an itemised handover record

The handover record should list each item, date, issuer, reference, page count and whether it is an original or copy. Identify attachments and language versions. Record physical delivery and electronic transfer separately, including any access limitations or expiry of links. Do not describe a folder as complete merely because a large number of files were transferred. Compare it against the inventory and outstanding institutional requirements.

Mark missing items explicitly and assign responsibility for follow-up. A recipient can acknowledge possession of listed documents without agreeing that the agency fully performed the service or that all financial claims are settled. The wording should reflect that limited purpose. Check that no release or admission has been embedded in the receipt. A practical completion test is whether the new authorised person can identify the current version, verify its source and locate the next required action without relying on undocumented explanations from the former employee.

Transfer knowledge of pending applications, not just PDFs

A useful handover includes application references, submission dates, recipients, last official responses, supplement requests and the status of original documents already lodged. Ask whether any appointment was booked, whether fees were paid and whether a response has been received but not forwarded. Verify important facts directly with the institution through an authorised channel. A folder of scanned certificates can be extensive yet omit the only reference needed to locate a pending matter.

For Chinese first passport or travel-document work, distinguish material collected by the agency from material actually submitted to the Embassy. Do not infer an application exists because an intermediary said processing had started. Use the official reference and current directions when changing contact details or supplying documents. A new coordinator should not open a duplicate application simply to obtain control. Parentage, nationality and issuing decisions remain with the competent authorities; transferring the file does not decide them.

Preserve confidentiality through closure and transfer

Closure does not make the family's data available for unrestricted sale, publication or circulation. Identify which organisation is responsible for stored records and any transfer to a new provider. Limit access during the transition, revoke unnecessary staff permissions and preserve necessary evidence securely. If an external processor is involved, its contractual and statutory obligations must be assessed; do not assume that a service cancellation gives it freedom to reuse the data.

Ask which records must remain for legal retention or claims, which working copies can be deleted and who will handle future access requests. Keep the child's interests and other individuals' confidentiality in view. An overseas handover also requires international-transfer analysis rather than a generic consent clause. Treat formal liquidation and archives as a distinct branch

If liquidation is registered, direct the relevant request to the authorised liquidator and obtain a reliable archive contact. The Entrepreneurs Law contains company-document retention rules, including Article 89, but those rules should not be read as an automatic right for every customer to inspect every company record. Patient confidentiality, personal-data restrictions and the nature of the requested document still matter. Ask how the particular family's records can be requested lawfully after operations cease.

Document retention and creditor recovery are separate. The existence of an archive does not establish that money is available, that a claim has been admitted or that a filing deadline has been met. If insolvency, liquidation notices or a dispute procedure may affect financial rights, obtain advice on the actual proceeding and dates. Do not import a generic deadline from another guide. Where a company has been removed from the register, further steps may require individual legal analysis rather than an ordinary customer-service request.

Hypothetical example: a coordinator leaves and a new company appears

Suppose an agency closes its office, a former employee offers to hand over a cloud folder, and a new company asks the family to sign a full release before continuing. The family has a pending document application but no reliable submission reference. It should first verify the old entity's status, identify the actual holder of the reference and preserve the folder without broad redistribution. It should then check the employee's authority and the proposed new company's role.

An itemised handover can separate receipt of documents from acceptance of a release. Missing registry or clinic documents may be sought directly by an entitled person, while financial claims are reviewed separately. The new representative can confirm the pending application's status through the proper channel before taking further action. This is a hypothetical preparation example, not a reported client result. Escalate with a defined objective and evidence bundle

If a specific request is refused or ignored, preserve the request, proof of delivery, responses, inventory and evidence of urgency. Define the remedy needed: return of a particular original, information on an application, access to personal data, preservation of evidence or a financial claim. Different objectives may require different legal routes. A public accusation is not a substitute for obtaining a document, and involving authorities requires a factual basis appropriate to the issue.
