Public Agency Disputes
Understand the decision, preserve the deadline and choose the proper remedy for a dispute with a Georgian public authority.
Before acting, verify the legal basis, deadline and consistency of the documents. This guide is a preparation framework, not an individual legal opinion.
Step-by-step process
- Send an initial summary identifying the authority, the decision or missing response, the date received and the result you seek. Flag any enforcement date; agree a suitable channel before sending sensitive documents.
- Identify the operative act, proof of notification, applicable special rules and whether an administrative complaint must first be used. Prepare a deadline and procedural-route assessment.
- Compare the reasons given with the application, evidence and accessible agency file. Identify missing records and lawful requests; access to third-party or protected material is not unrestricted.
- Agree the scope and prepare the appropriate complaint, claim or other request, including an interim-protection application where justified. Preserve filing and delivery evidence.
- Review the response and agree any hearing, court representation, further appeal or enforcement work separately. A favourable procedural ruling may require reconsideration rather than automatically granting the requested benefit.
Required-document checklist
- The complete decision, refusal letter, notice and attachments, with envelope, electronic delivery record or publication details showing relevant dates.
- Your application, registration/receipt confirmation, requests for additional information, replies and any previous complaint or court papers.
- A short chronology and the records supporting the disputed facts, such as eligibility, payments, property, permits or inspection findings.
- For an IDP cash-compensation decision: the submitted household form, supporting records, monitoring findings available to you, prior housing-programme history and the director's act or refusal notification.
- Representation documents and translations if needed. Provide identity, household, health or financial records only through the agreed channel and only where relevant.
What will I receive?
The agreed stage can produce a written route and deadline assessment, an evidence-gap checklist, a case-file request, a complaint or claim draft and representation. Specify included filings, hearings and response review. A later appeal or enforcement stage is not automatically included.
Is this the same as claiming damages from the state?
No. Reversing an act, obtaining a new decision, requesting programme assistance and recovering proven loss involve different requirements. We identify the requested remedy and any additional claim. Consultation language, remote participation and representation arrangements are confirmed for the matter; website translations do not establish availability in every language.
Key risks and common mistakes
- Treating the date of an informal conversation as the only relevant deadline evidence, or assuming that further correspondence restarts time.
- Using an ordinary administrative complaint where the applicable act or special procedure requires a different route; court admissibility must also be checked.
- Assuming that a complaint, court filing or consultation automatically stops every enforcement measure. Suspension rules have exceptions.
- Confusing programme cash assistance with damages for unlawful public action, or assuming that a successful challenge guarantees a payment, licence or dwelling.
