US appeal vacates an injunction containing fabricated material: the lesson for AI-assisted legal work
The Fifth Circuit vacated a Mississippi education-law injunction and ordered reassignment. Its criticism of fabricated facts and citations illustrates why source checking must reach the record.

The actual disposition
On 22 October 2026 the Fifth Circuit vacated a preliminary injunction and ordered reassignment in Jackson Federation of Teachers v Fitch, No. 25-60496. The litigation concerns Mississippi education legislation. The majority criticised fabricated factual material and a non-existent citation in district-court orders, as well as the legal analysis.
The decision should be described precisely. Vacating interim relief does not itself establish a final merits judgment on every application of the statute. The court remanded for further proceedings before a different judge. The concurrence agreed with the operative disposition while emphasising the need for a fuller look on remand.
A plausible citation is not verified authority
Our practical assessment is that checking whether a case name looks realistic is insufficient. A legal proposition needs a real source, the correct passage and a procedural context in which it supports the proposition. A genuine judgment can still be misused by omitting a qualification or treating a preliminary issue as a final holding.
The same applies to facts. A declaration, party or quotation should be traceable to the actual record. A document created by an AI system cannot establish that a witness made a statement or that a party filed evidence. Keep the underlying file and the reference that allows another person to locate it.
Interim relief requires a reasoned legal basis
The opinion also discusses the requirements and scope of preliminary injunctions. It treats the probability-of-success analysis and the breadth of relief as substantive issues, rather than assuming that high stakes justify a pause automatically. An applicant needs evidence and reasoning directed to the relevant test.
For a litigant, the useful preparation is a table linking each requested order to the alleged harm, supporting evidence and legal basis. That table should survive removal of any disputed or unreliable source. If the argument collapses without an unverifiable citation, the correct response is to reassess it, not to replace the citation with another plausible name.
Use AI with an accountable review process
AI can assist with organisation, translation or a first draft, but its output needs checking against primary material. Distinguish an actual judicial finding from the tool’s interpretation. Record uncertainty and ensure that a qualified person responsible for the filing has considered the applicable duties before material is submitted.
This US decision does not establish a new universal Georgian procedural rule or ban every use of AI. Its relevance for Georgian lawyers, developers and clients is evidential discipline. A source-linked article or draft should enable a reader to inspect the authority and understand what it actually establishes, including the limits of the result.
A verification process that reaches the substance
- Locate every authority in an authentic source.
- Check the quoted passage and the proposition it supports.
- Trace factual assertions to the actual evidential record.
- Review procedural status, requested relief and unresolved issues.
