According to Imedi's report of 8 October 2026, Tamaz Elizbarashvili's lawyers planned to submit a plea bargain request to the Prosecutor's Office; the report also describes a confession of threats. As the report discusses a case involving the television company's own employees, the factual description is attributed to this source. A signed agreement, court approval, and a full indictment are not presented.

A request does not mean approval of the agreement

Article 209 of the Criminal Procedure Code defines the grounds for an agreement. Article 210 allows the accused and the prosecutor to offer an agreement and requires the direct participation of a lawyer. Sending a request does not automatically result in the acceptance of desired terms or the prosecutor's consent.

A public or media confession is not equivalent to an approved plea bargain. An agreement requires awareness of its content, adequate legal assistance, and the procedure provided by law. A possible reduction in sentence is a matter for the specific agreement and court assessment; based on the information, we cannot specify a particular term in advance.

Court review is not a formality

Article 212 of the Code requires a written agreement and court approval. The judge must verify voluntariness, the absence of coercion or unlawful promises, awareness of the consequences, and the possibility of defence. Article 213 also provides for the verification of the substantiation of the charges and the legality and fairness of the sentence.

The court has the possibility to disapprove the agreement if the relevant requirements are not met. Therefore, a statement by a lawyer or prosecutor cannot replace the court's final decision. To assess the actual quality of the review, the text of the agreement, hearing materials, and the court's act are required.

Victim's Rights

Under Article 217, the prosecutor must consult with the victim before the agreement and inform them of its conclusion. The victim can provide the judge with information on the damage caused. This article does not grant them the right to appeal the agreement, but they retain the right to a civil claim. Consultation does not imply an individual veto right.

The guarantees of a fair trial under Article 6 of the European Convention, which is binding for Georgia, also apply to the plea bargain procedure. Entering into an agreement requires an informed and voluntary choice regarding rights. This article does not define the final qualification or guilt regarding specific threats: the existing source allows us to explain the information about the request, while describing an approved agreement without additional court documents is impermissible.
