Goods and Funds Worth GEL 106,000: When an Unfulfilled Agreement Constitutes Fraud
According to the Prosecutor's Office, goods and funds worth GEL 106,000 were received from a company representative during an agreement to supply products to a retail chain; one person was charged with large-scale fraud. An unfulfilled commercial obligation does not, by itself, confirm fraud.

According to a report by the Prosecutor's Office of Georgia on 7 October, the director of a business organisation was charged after, according to the investigation's version, promising one legal entity to supply products to a retail chain, and in return received and misappropriated goods and funds — totalling GEL 106,000 in value. The Prosecutor's Office reports that the person was arrested by a judge's order, and the court imposed pre-trial detention. The charge is brought under Article 180, Part 3, Sub-paragraph 'b' of the Criminal Code, the sanction for which provides for imprisonment from six to nine years.
This description is based on the Prosecutor's Office's statement. The contract, delivery documents, the positions of the company and the accused, and the court's pre-trial detention order are not included in the public information. Therefore, we do not yet know what evidence the investigation relied upon regarding the intent and the circumstances of obtaining the property.
Showing only debt or an unfulfilled condition is not sufficient for fraud
Article 180 of the Criminal Code defines fraud as the appropriation of another's property or the acquisition of a property right by deception, with the aim of unlawful appropriation. In cases of large-scale commission, Part 3, Sub-paragraph 'b' establishes imprisonment from six to nine years.
In a commercial relationship, the timely supply of a product, its sale, or the return of funds may become the basis for a contractual dispute. To determine whether a crime has also been committed, the investigation must present evidence of deception and the intent to unlawfully obtain property. Subsequent non-performance does not automatically answer the question of what intent the person had when entering into the agreement. On the other hand, the existence of a contract cannot, by itself, rule out fraud if elements of deception are separately confirmed.
For the assessment of the case, correspondence, settlements, acts of goods transfer, actual negotiations with retail chains, the subsequent movement of the received property, and whether the party had a specific plan for fulfilling the agreement may be important. Without these materials, a final distinction between civil and criminal liability cannot be made from public information.
The pre-trial detention of the accused is a measure of restraint and not a punishment; a person is presumed innocent until the crime is proven by a legally binding verdict. The accused can use the services of a lawyer, appeal the detention, and present defence evidence. Businesses, in turn, can separately assess the issue of civil claims provided for by the contract. International Guarantees and the Operation of Law Over Time
The European Convention on Human Rights is binding on Georgia. Article 6, Paragraph 2 protects the presumption of innocence, while Paragraph 3 protects the minimum guarantees for the defence of the accused, including assistance from a lawyer. These guarantees are also important when evaluating public information about the bringing of charges; a public statement cannot replace proof in court.
In this article, the sanction is described according to the text in force as of 9 October 2026. The public information does not specify all dates of the alleged actions; the criminal law applicable to the specific case and the retroactive effect of a lighter law, according to Articles 2 and 3 of the Criminal Code, must be checked taking into account the date of the action.
Legislation checked as of 9 October 2026.
