Protecting a Chinese brand in Georgia requires choosing the sign and goods, checking earlier rights and identifying the proper applicant. Chinese characters, Latin name and logo do not automatically protect each other to the same extent. Short answer: the basis for Georgian protection
Before introducing a Chinese brand in Georgia, identify the sign requiring protection, the relevant goods and the intended owner. A Chinese registration does not itself create Georgian trademark rights. Georgian law provides protection through Sakpatenti registration or an international agreement, with a separate exception for a mark well known in Georgia that should not simply be assumed. Trademark protection should therefore be a separate workstream in the market-entry plan.
A company name, domain registration and social-media account serve different purposes. None alone establishes Georgian exclusive trademark rights in the brand. They may still be important commercial assets and their relationship with other parties' rights may need assessment. Create an inventory separating brand names, logos, accounts, owners and territorial protection. This makes visible what already exists and which steps remain, before packaging, advertising and distributor commitments become expensive to change.

Chinese characters, Latin name and logo
A Chinese word mark, Latin spelling and logo may all point consumers to one business, but an application needs a precisely defined sign. Putting everything into one combined image does not automatically mean every word and future design is independently protected. Identify the versions used on products, storefronts, online sales and advertising. If customers will mostly encounter the Latin name, a strategy built solely around the Chinese label may not reflect that use.
Prepare exact files showing the Chinese characters, pinyin or other Latin form, graphic logo and proposed Georgian pronunciation. Distinguish official versions from marketing drafts. Do not silently alter the image while preparing the application. Assess word, figurative and combined-mark choices alongside the goods. Every business need not adopt the same filing package: the selection should reflect actual use, risk and budget, with each proposed application considered on its own merits.

Translation and consistent spelling
Describing a foreign-language word mark involves more than uploading a logo. Sakpatenti's instruction addresses transliteration, transcription and translation where possible. For a Chinese name, establish the exact characters, pronunciation and meaning. The explanation must reflect the language accurately; a convenient but incorrect translation undermines assessment. Do not assume a translated word, pinyin version and Georgian rendering automatically constitute the same sign.
Keep the owner's legal identity recognisable across application, power of attorney, Chinese corporate records and Georgian translation. A working table can place the original, agreed Latin form and Georgian form together, with registration identifiers distinguishing similarly named companies. Consistency supports an accurate record but does not itself create ownership. If a partner adopts another spelling, ask why and decide whether it calls for assessment of a new sign or correction of documentation.

Search beyond the exact name
Search the Chinese name, Latin version, plausible spelling variants and similar logo elements. Check national records through Sakpatenti's official search and relevant international records through WIPO tools. WIPO warns that its international database does not replace every national register. No result in one database is therefore not legal clearance. This article does not clear any specific brand for registration.
Assess each result beyond word similarity: owner, status, priority, goods and territorial effect matter. A similar name on unrelated products and the same name on your products raise different questions, without an automatic answer. Preserve significant results with the search date and query variant. If the Chinese name returns nothing, examine transliteration and likely local pronunciation. Connect the final marketing-name decision to the search assessment before printing a substantial packaging run.

Language choice does not remove refusal risks
Georgian law addresses distinctiveness and absolute and relative grounds for refusal. Chinese characters are not automatic proof that a name will be registrable. Assess the sign's function for the actual goods, descriptive or misleading meaning and earlier rights. For example, a simple description of a product characteristic may not function as a sign distinguishing one undertaking from another. An unusual-looking script cannot replace the legal assessment.
Separate whether the sign itself satisfies requirements from whether relevant earlier rights conflict with it. Accurate translation informs the first question; searching informs the second. Consider consent or another possible response only under the relevant legal ground. Do not promise that a colour, font or single-letter change will remove every obstacle. The business's Chinese origin does not itself answer whether consumers in Georgia could confuse the signs.

Classes and a precise goods list
Protection is not planned around the brand name alone: the application needs a goods or services list. Article 11¹ of Georgian law requires a clear scope and international classification. A class number is not a universal monopoly over every product. Describe actual goods rather than relying on vague wording. Do not copy the Chinese list into a Georgian filing without checking products and commercial objectives.
Build a catalogue describing product functions and intended uses. Separate branding of goods from any independently supplied service. A name used to sell equipment and the same brand used for a distinct service may need different analysis. Have the commercial team review the final list so that key products are not omitted and unrelated activities are not inserted. Class choices affect budgeting, but no specific fee is established here. A carefully drafted initial list also supports planning for later territorial expansion.

Decide the applicant and owner in advance
A Chinese group may own the brand, another factory may manufacture and a third company may sell in Georgia. Resolve ownership before filing. The applicant's name is not an administrative detail. Identify the person intended to obtain protection and verify its full legal particulars. A Georgian subsidiary does not automatically acquire its parent's intellectual property simply because the entities share shareholders.
Keep existing registrations, assignment documents and relevant corporate authority. Decide whether a local company's use is licensed or whether ownership is being transferred; these choices allocate control differently. For an assignment, assess the necessary Georgian register entry rather than relying solely on an internal group letter. Distinguish owner, applicant and representative throughout the papers. Authority to file an application does not make the representative the brand owner.

Distributor filings and the contract
A distributor can assist with filing, but registration in its own name can place control at risk. Specify who owns the mark, whose name goes on the application, who receives office communications and who pays. Saying the partner will handle registration answers none of these questions. Check brand files and the limits of authority before cooperation, especially where several entities and languages are involved.
Georgian law provides possible annulment grounds involving bad faith and, under stated conditions, unauthorised filing by an owner's representative or agent. This does not mean every distributor registration will automatically be cancelled. The relationship, consent, facts and applicable ground require assessment. As prevention, agree restrictions on own-name and related-sign filings, notification duties and cooperation after termination. Address domain and social-account control separately: a trademark clause does not automatically transfer those digital assets.

The Georgian application: data and process
The national application work includes applicant details, representation of the sign, goods list and required authority documents. The law provides for a Georgian-language application referring to one mark. Prepare the Chinese company's identity, address, authorised signatory and consistent translation as well as the logo file. If protection for different signs is intended, consider each representation separately instead of sending an unclear collection of alternating designs.
Sakpatenti's Georgian procedural page distinguishes formal examination, substantive assessment, publication and possible challenge. Filing is not completed registration. Plan checks of form, refusal grounds, responses and later stages. An accelerated route is not a guarantee that legal obstacles disappear. The Madrid route and designation of Georgia
If eligible for Madrid, assess an international route alongside a national filing. WIPO requires a qualifying connection to a member and a basic application or registration at that member's office. A Chinese mark may form part of this plan, but verify eligibility, sign identity and the territorial request. Starting business in Georgia does not automatically mean every existing Chinese mark can be extended unchanged. Owner particulars and the goods list matter too.
Designation of Georgia and a WIPO registration certificate do not replace the Georgian substantive assessment. After WIPO's formal stage, the designated office applies its domestic law; Article 41 of Georgian law expressly addresses examination of an international mark extended to Georgia. Check Georgia-specific status and covered goods, not just the international number. A refusal notification may require a local response. Assess changes to the mark or list in advance instead of assuming international filing protects all future products.

What to prepare before filing
Build a folder connecting owner, sign, goods and intended use. Include relevant Chinese corporate identifiers, existing registrations or international numbers, exact brand files, meaning and pronunciation, product catalogue and search results. Tell the representative which versions are final and which are drafts. Clarify dates and contents of similarly named files so that the wrong logo is not accidentally filed.
Keep design-creation and rights-acquisition documents, intra-group assignments, distributor agreement and authority documents where relevant. This practical list is not a universal set of legally mandatory annexes; it exposes questions early. If claiming priority, assess the first application and supporting requirements separately: an earlier Chinese sale is not simply a substitute. Before submission, obtain written approval of the final owner, name, representation and goods list from the responsible business contact.

After filing: communications and evidence of use
After filing, assign a person to monitor office communications. Requests may concern data, the goods list or substantive obstacles. Publication matters because interested parties may challenge a decision. Compare the actual notice's timing with the operative Georgian rules. Late forwarding to a Chinese head office does not itself extend a legal deadline. Agree who receives, translates and answers communications.
After registration, retain evidence of market use: product photographs, dated sales material, invoices, advertisements and licensed-partner records can matter. Keep Georgian-market evidence where Georgian use is at issue instead of relying only on a general Chinese campaign. The law provides cancellation grounds involving non-use and other circumstances, requiring assessment rather than an assumed automatic result. Track owner and address changes, licences, renewal and register accuracy. Receiving the certificate does not finish brand management.

Ownership problems and source currentness
If a partner has already filed in its own name, obtain the exact record and establish whether it is an application or registration. Collect brand history, consent or its absence, agency relationship, correspondence and use evidence. The issue may involve contractual performance, assignment, administrative challenge or judicial annulment. The route depends on facts and procedural stage. Assess rights and remedies before promising an outcome or publishing broad accusations.
