US immigration civil penalties: the October final rule, postal delays and preserving an appeal
The October 14 final rule retains the streamlined civil-penalty procedure and adds a limited exception for documented postal delays. A fine appeal and a removal challenge are separate matters.

What changed on 14 October
The DHS and Justice Department final rule took effect on 14 October 2026. It finalises the June 2025 procedure for specified immigration civil penalties, adding a limited route for acceptance of a late appeal where documented mail-delivery delay was beyond the person’s control. This is a procedural development, not a new fine imposed on every foreign national.
The covered statutory grounds concern failure to depart during a voluntary-departure period, specified conduct including willful failure or refusal to depart after a final removal order, and improper entry or attempted entry. They arise under INA sections 240B, 274D and 275(b), respectively. The facts and legal elements of the particular ground must be established; a person’s nationality or the existence of a pending application does not answer that inquiry.
The decision and the appeal record
Under 8 CFR 281.1, the written decision identifies the statutory basis, amount and reasons, and explains the appeal process. Review takes place within DHS under this procedure rather than through an appeal to the Board of Immigration Appeals. The ordinary appeal window is 15 business days under the rule’s service provisions. A person should use the exact instructions and service date in the actual notice, retaining proof of both receipt and dispatch.
The new exception is narrow: ICE must assess the evidence of delayed mail delivery case by case. It should not be treated as a general extension for misunderstanding the notice, forgetting a deadline or needing more preparation time. The final rule specifically discusses contemporaneous evidence of depositing an appeal with the postal or commercial carrier. Placing an envelope in an ordinary collection box may not create equally clear proof of the dispatch date.
Challenge the correct issue
A useful appeal separates disputes about identity, the underlying statutory ground, the relevant dates and the amount. Evidence should respond to the actual reason given. If the allegation depends on willfulness, records explaining why departure was impossible may have a different legal role from a bare assertion that travel was inconvenient. The available defence depends on the statutory provision; this article does not assume one defence applies to every category.
A challenge to the monetary penalty is also different from a challenge to the removal order or a request to suspend enforcement. Winning or filing one does not necessarily dispose of the other. Where several decisions coexist, each needs its own deadline and remedy analysis. A general request to reconsider “the immigration case” may fail to identify the decision that must be appealed.
Departure and a move to Georgia
The rule discusses circumstances in which qualifying departures through the government’s designated process may lead to rescission of outstanding penalties. That should not be converted into a promise that any departure erases a debt. A person considering such a route needs current written confirmation of eligibility and the consequences for future admission, pending claims and family members before acting.
Georgia is a separate jurisdiction. A US departure arrangement does not establish a right to enter Georgia or remain there. The receiving-country plan must be assessed under the Georgian Aliens Law and, if work is planned, the Labour Migration Law. A person should not book an onward journey on the assumption that an administrative fine or removal document functions as a visa.
A practical response file
- Keep the complete order, envelope, tracking and actual receipt date.
- Identify the statutory ground and calculate the business-day deadline under the service rules.
- File through the specified channel and preserve time-stamped evidence of dispatch.
- If relying on postal delay, document why it was beyond your control.
- Review monetary liability, removal, future travel and destination-country status as separate questions.
For another distinct US deadline, see our refugee-status notice analysis. The central lesson is to work from the individual order and applicable provision, rather than a general headline about immigration fines.
