US cancellation-of-removal forms enter a new comment stage: what applicants should check

A 30-day consultation concerns Forms EOIR-42A and 42B. Proposed form changes do not remove the legal eligibility tests or suspend a court deadline.

A form review, not a new immigration status

The 26 October Federal Register notice opens a further 30-day comment period on cancellation-of-removal applications. Comments are due on 25 November 2026. EOIR-42A concerns certain permanent residents; EOIR-42B concerns certain nonpermanent residents. These are separate applications with different legal requirements, rather than interchangeable ways to obtain permission to stay.

The notice describes revisions to visa information in question 21, removal of certain fields in part 7, and signature and affirmation arrangements in part 9. It also addresses instructions and fees. Those changes concern how information is collected. They do not themselves replace the requirements of section 240A of the Immigration and Nationality Act.

Use the currently accepted edition

An applicant facing an existing filing date should consult the official EOIR forms and fees page and the instructions applicable to the court. A consultation notice should not be treated as permission to wait until comments close. Retain the edition used, payment evidence and proof of filing or service.

The proposed simplification of a question does not make an underlying fact irrelevant to the case. Immigration history, entries, departures and earlier proceedings should remain traceable. Where an answer requires explanation, a dated chronology can reveal inconsistencies before the application is signed.

Eligibility and discretion remain distinct

Cancellation requires analysis of the relevant statutory route and any applicable bars. Satisfying a form checklist does not establish that relief will be granted. Nor does submitting comments about the forms amount to an application, an appeal or a stay of removal. An individual case needs its own procedural assessment.

In a hypothetical case, a person preparing EOIR-42B discovers that an old entry record conflicts with a date remembered by a relative. The useful response is to identify the reliable record and explain the discrepancy. Selecting whichever date appears more favourable risks undermining the evidence rather than resolving it.

Keep consultation comments separate

Comments can address clarity, burden or practical difficulties with the proposed collection. Case evidence belongs in the appropriate case process. Avoid publishing passports, medical records or identifying details in a public comment merely to illustrate a drafting problem. Describe the issue without unnecessary personal data.

Prepare for the actual court deadline

Before signing, match each material answer to supporting evidence and identify outstanding documents. Check the court’s directions, the accepted form edition and any fee or waiver requirements together. A form revision can improve presentation; it cannot cure a missed procedural deadline or establish facts that are not supported.
