Hong Kong’s October labour operations: unpaid work and a job offer can still breach immigration conditions

The October 16 report records arrests, not convictions. Its warning covers paid and unpaid work, employer checks and the separate identification of trafficking victims.

Arrests reported on October 16

Hong Kong’s Immigration Department reported 15 arrests following operations between 9 and 15 October 2026. The categories included suspected illegal workers, a suspected employer, a suspected aider and abettor and an overstayer. An arrest is not a conviction; the release says the employer investigation was continuing.

The accompanying warning highlights conditions that matter before work begins. Visitors cannot assume they may work simply because the arrangement is brief or unpaid. A person’s actual permission and the activity proposed need to be examined together. A friendly description such as helping out does not determine the legal classification.

Permission to enter and permission to work

The official Hong Kong employment guidance should be consulted for the relevant route. A job offer, an identity card and a pending application can each have evidential value without independently establishing unrestricted employability. The permission actually granted and its conditions are central.

Consider a visitor asked to cover shifts while an employer prepares paperwork. The employer’s intention to regularise the arrangement later does not answer whether the work may begin now. Before accepting, obtain a clear explanation tied to the actual permission, including any limitation to a particular employer or activity.

Employers need an active verification process

The release describes duties to examine documents and make enquiries about lawful employability. A checklist should record what was inspected, when, by whom and how doubts were resolved. Treating possession of a card as the end of the enquiry can leave unanswered questions about status or conditions.

Keep the offer, contract, hours, payment records and copies of the verification evidence obtained lawfully. If a worker’s permission is changing, identify the point at which the new activity becomes authorised. A payroll entry or contract start date should not be used as a substitute for that immigration assessment.

Exploitation requires a separate response

The department describes screening arrested vulnerable people for trafficking and forced-labour indicators and support for identified victims. Immigration irregularity should not cause evidence of coercion, threats or withheld documents to be ignored. The facts may raise both a status issue and a protection issue, requiring coordinated advice.

For people considering Georgia as another destination, Hong Kong permission does not transfer. Review the Georgian Aliens Law and the applicable work framework for the proposed Georgian activity. Resolve any existing proceedings or travel-document problem before assuming relocation will remove it.

Before the first shift

  • Identify the exact permission and work conditions.
  • Check whether the activity is authorised even if unpaid.
  • Keep employer enquiries and supporting documents.
  • Record coercion or exploitation concerns and seek the appropriate protection channel.
