What is changing?

Australia has made regulations changing where an applicant for a Subclass 407 Training visa must be when applying and when the visa is granted. The amendments start on 12 November 2026 and apply to applications made on or after that date. They do not establish an automatic grant or remove the other visa requirements.

The amending regulations, registered on 30 October, generally require an applicant to be outside Australia when making a valid application and again at the time of grant. Schedule 1 also creates an exception for a class specified by the minister in a separate legislative instrument. Someone in that class may be inside or outside Australia, but not in immigration clearance, subject to the instrument's terms. The grant exception refers to the applicant's membership of the specified class at the time of application.

Who should pay attention?

The Training visa is intended for eligible workplace training or professional development, according to the government's explanatory statement. A prospective applicant already in Australia should check the date of application, location and any current specified-class instrument before making travel or filing plans. A sponsor should also check whether its training arrangements and nomination remain suitable for the particular application.

The amendment itself provides for specified classes but does not identify them. Do not assume that an occupation, a family relationship or a current visa automatically creates an exception. The location requirement is separate from other criteria, and an application made from outside Australia is not guaranteed to succeed. Applicants whose applications were made before commencement should check the transitional provision and their individual circumstances; the amendments say they apply to applications made on or after commencement.

Practical next steps

Keep the current visa and expiry date, proposed training plan, sponsorship material, intended filing date and travel history together. Check the official regulations and any later instrument before acting, and seek advice from an appropriately authorised Australian immigration professional on the facts. Leaving Australia can affect existing immigration arrangements; that should be considered before travel. Deadlines and options depend on the individual case.
